General terms and conditions

1. Contractual object

The concluded contract comprises the training of the martial art «Muay Thai» (traditional Thaiboxing). The student agrees to attend training at least twice a week. Training is carried out three times a week, according to the training plan. The martial arts school reserves the right to change and optimize training times and days at any time and at his own discretion. We guarantee each student of the Muay Thai Shadow Boxing School a disciplined and qualified training place.

The validity of general terms and conditions: Through possible adjustments, the general terms and conditions published on the homepage (mtsb.ch) apply.

2. Rules

  1. The student agrees to use his/her knowledge of martial art only in case of self-defence or in a sporting sense like in competitions.

  2. The membership of our school is prohibited for those who are active members of extremist, political or religious organizations that see violence as a solution and that spread hate.

  3. The membership of our school is prohibited for those who are actively in contact with hard drugs (as consumer or dealer)

  4. The student is asked to have a clear head during the training. This means that he/she is forbidden to show up for the training under the influence of narcotics, alcohol or drugs.

  5. The word «respect» is largely written in our school! We are providing knowledge of an Asian art of combat and would like to pass this on in the spiritual sense. Therefore, the word respect stands for the behaviour towards the coaches and their voluntary work as well as for the martial art Muay Thai itself. Also training partners have to be treated in a respectful manner. We neither tolerate any lack of concentration or disruptive behaviour nor any refusal of training exercises.

3. Hygiene

To prevent injuries (such as cuts), feet- and fingernails are to be shortened to an appropriate length. The student is asked to wash his/her feet before the training. Every student needs to bring a towel.

4. Insurance

Every student is obligated to be provided with sufficient personal insurance cover (accident and liability). The school rejects any liability towards students that is going beyond the mentioned insurance cover!

5. Health

By signing the contract, every student, as well as the legal representation, expressly acknowledge to feel healthy at the time of the application. If this is not the case or if this should change in the course of time, the student is asked to get medical treatment in order to clarify the ability of a further exercise of the training. The student is asked to inform his/her coach immediately about any lack of medical fitness.

6. Highly personal demands

By signing the contract, every student, as well as the legal representation, expressly acknowledge to be aware of the fact that while learning a martial art, pain, blows and injuries can be suffered. The student, as well as the legal representation explicitly waives any right to assert claims for damages, amends, disability costs, costs of accidents or medical expenses. All claims against the coach or student shall be excluded.

7. Badge (electronic locking of entry and elevator)

For a flexible access to our gym, every member needs a badge. Every new member gets this badge after having handed over the application. A deposit payment of CHF 50.- will be charged. This deposit will be refunded upon return of the undamaged badge and upon payment of all outstanding amounts (invoices of MTSB). If the badge gets lost or damaged, the student will be charged with an amount of CHF 50.- in order to replace the badge. Every student needs to obtain a badge at the beginning of his membership at Muay Thai Shadow Boxing School. The badge is not transferable. Every registered student is responsible for his badge.

8. Combo Subscription

This subscription allows to participate in all standard courses of the Muay Thai Shadow Boxing School. Every active member is aware of the fact that it is not possible to start off in every level and that the owner of the school (Roger Rubi) needs to be consulted. Also due to organisational reasons it is necessary to consult Roger Rubi in order to discuss the planned training sessions.

9. Costs, contractual period, termination

After having completed the second test training, the student will be officially admitted to the Muay Thai Shadow Boxing School. The contracts are offered according to page 1 « application form ». Any holidays (summer, winter), in which no trainings will be offered, don’t affect the subscription period. No suspension or refund of the membership contribution. In case of an injury or accident, a medical certificate needs to be submitted and Roger Rubi needs to be consulted regarding the subscription period. Minor accidents or influenza will not be taken into consideration. Refunds will generally not be paid.

The contract must be terminated before the end of the current subscription. Notice of termination must be given in writing and by registered mail. Membership contributions are to be duly paid by then. The contract extends tacitly. Important: the contributions need to be paid in advance!

During our company holidays and on public holidays, our MTSB-locations are closed. These are as follows: in summer usually by the end of July/beginning August. In winter mostly over the new year period.

Pausing of subscription is possible if the absence is of longer than 2 weeks duration. The subscription will be extended by the period that exceeds two weeks. Example: 3 weeks’ vacation = 1 week will be credited.

10. validity AGB

The terms and conditions published on the homepage (mtsb.ch) shall apply in the event of possible adjustments.

11. Applicable law | place of jurisdiction

Swiss law applies. The place of jurisdiction for all disputes arising from this contract or disputes between members and the school is Brügg BE.
